On February 6, 2026, Governor Kathy Hochul signed the New York Medical Aid in Dying Act into law. This historic legislation expands end-of-life options by allowing terminally ill, mentally capable adults with a prognosis of six months or less to request and self-administer medication for a peaceful death.

While the signing is a major milestone, there is a built-in implementation period before clinical services can begin. Below are the critical dates and details families need to know as they navigate this new chapter in New York healthcare.

Key Implementation Timeline

  • February 6, 2026: The Act was officially signed into law.

  • February – July 2026: This six-month window allows the New York State Department of Health to establish necessary regulations and guidance for patients, healthcare facilities, and providers.

  • August 5, 2026: The law officially takes effect, and clinical aid-in-dying services can legally be provided to eligible patients.

What Happens During the "Waiting Period"?

Currently, the independent clinical network supported by Quiĕtus is in a "Pre-Planning" phase. While prescriptions cannot be written until August, our clinicians can provide educational consultations and pre-planning support. 

Eligibility at a Glance

To qualify for medical aid in dying in New York when the law becomes operational, an individual must:

  1. Be at least 18 years old and a resident of New York State.

  2. Have a terminal illness with a life expectancy of six months or less, as certified by two independent physicians.

  3. Possess the mental capacity to make an informed healthcare decision.

  4. Maintain the physical ability to self-administer the medication.

A Note on the New NY Safeguards

New York’s 2026 Act includes some of the most rigorous safeguards in the country. This includes a mandatory mental health evaluation for all patients and a unique requirement for the oral request to be recorded via audio or video. These measures ensure that every transition is pursued with full autonomy and without coercion.
